Disaster Recovery Backups

Incontech conducts nightly disaster recovery backups where we backup all our SharePoint sites and mailbox stores every night. These backups are to protect our customers in the extremely unlikely event that a system failure or other event that requires the recovery of an entire mail store or Sharepoint site occurs. If a customer needs a specific SharePoint site recovered due to no fault of Incontech Ltd, we may charge a service fee for this recovery service. Incontech does not support the ability to restore an individual item from a SharePoint site or restore an individual message that has been deleted from a mailbox and is not recoverable from the deleted item retention cache. Customers who need the ability to restore individual messages should consider the Advanced Exchange Archiving service. Incontech Ltd test there disaster recovery procedures on a regular basis but no responsibility can be accepted for any data loss experienced due to data that cannot be restored.

Intellectual Property

Incontech Ltd hereby grants to Customer a non-exclusive, non-transferable, royalty-free license, exercisable solely during the term of this agreement, to use applicable technology solely for the purpose of accessing and using the services provided. Customer may not use the technology for any purpose other than accessing and using the services. Except for the rights expressly granted above, this agreement does not transfer from Incontech Ltd to Customer any technology, and all rights, titles and interests in and to the technology shall remain solely with Incontech Ltd. Incontech Ltds trade names, service marks, logos, other names and marks, and related product and service names, design marks and slogans are the sole and exclusive property of Incontech Ltd. The customer may not use any of the foregoing in any advertising, publicity or in any other commercial manner without prior written consent.

Use of Microsoft Outlook® Software

Incontech Ltd hosted exchange service includes the licensing for Microsoft Outlook® Software. The license fee is included with the customer monthly service fee. End-users are allowed to install the software one time and only on one PC for each Incontech Ltd mailbox. Each end-user/individual using the service must purchase an individual Subscriber Access License (SAL) – otherwise know as a “mailbox” for this service. Unfortunately, sharing of a single mailbox is not allowed unless additional licenses are purchased on a monthly basis for each user. If you cancel your hosted service account you acknowledge that you are responsible for uninstalling any Microsoft Outlook® client software that is licensed as part of the Incontech Ltd service.

Indemnification

The customer agrees to defend, indemnify and hold harmless Incontech Ltd against any liabilities arising out of defective products sold to customers, personal injury or property damage caused by products or services sold or distributed from Incontech Ltd servers, any material that infringes or allegedly infringes on the rights of a third party available from Incontech Ltd servers, and any material that libels or allegedly libels a third party available from Incontech Ltd servers

Incontech Ltd is not responsible for any damages to any customers business. Incontech Ltd makes no warranties or guarantees of any kind, expressed or implied for services that we provide. Use of Incontech Ltds hosted services is at the customers sole risk. Incontech Ltd services are provided on an "as is, as available" basis. Incontech Ltd does not guarantee that our services will be uninterrupted or error free. Incontech Ltd do however provide every effort in good faith to ensure that its services are available with minimal service interruptions. In no circumstance will Incontech Ltd be liable for any claims resulting from the use or inability to use Incontechs hosted services - including, but not limited to, service interruptions, client errors, Internet connectivity problems, miscommunications, unauthorized access to Incontech servers, InterNIC problems, DNS caching, Internet bandwidth congestion, power failures, vandalism, and natural disasters. Incontech Ltd reserves the right to revise our policies at any time
